3. TERMS AND CONDITIONS OF SALE
Governing Law and Prevailing Version
These Terms and Conditions are governed by French law.
In the event of any discrepancy between the English version and the French version, the French version shall prevail.

3.1 Purpose
These Terms and Conditions govern the sale of products on the Alignmentball website between ROCKCROC and any consumer.
3.2 Products
The essential characteristics of the products are described on the website. Product photographs are non-contractual.
3.3 Prices
Prices are indicated in euros, including VAT.
Shipping costs are specified before order confirmation.
ROCKCROC reserves the right to modify prices at any time.
For customers located in other European Union countries, VAT treatment may vary in accordance with applicable EU VAT regulations.
3.4 Orders
Placing an order implies full acceptance of these Terms and Conditions.
An order confirmation email is sent after validation.
3.5 Payment
Payments are secured and processed via the providers indicated during checkout.
3.6 Delivery
Products are delivered to the address provided by the customer.
Delivery times are indicative.
In the event of a delay exceeding 30 days, the customer may cancel the order.
Risk transfers to the customer when the customer takes physical possession of the goods.
Delivery is available within France and selected European Union countries.
Any customs duties or local taxes applicable outside the European Union shall be borne by the customer.
3.7 Right of Withdrawal
In accordance with Article L221-18 of the French Consumer Code:
The customer has fourteen (14) days from receipt of the product to notify their decision to withdraw from the contract, without giving any reason.
Notification must be sent by email to geo@alignmentball.com or by using the withdrawal form attached below.
After notification, the customer has fourteen (14) days to return the product.
Return shipping costs are entirely borne by the customer.
The product must be returned:
- In its original condition
- Complete
- Unused
- In its original packaging
- Accompanied by proof of purchase
Any damaged, used or incomplete product may not be refunded.
The refund will be made within fourteen (14) days from receipt of the returned product.

The customer may be held liable for any depreciation in value resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the product.
3.8 Legal Guarantees
Legal Guarantee of Conformity
The consumer has a period of two years from delivery of the goods to take action.
The consumer may choose between repair or replacement of the goods, subject to legal conditions.
The consumer is not required to prove the existence of a lack of conformity within twenty-four months following delivery.
Hidden Defects Warranty
The consumer may invoke the warranty against hidden defects under Article 1641 of the French Civil Code.
3.9 Force Majeure
ROCKCROC shall not be held liable for failure or delay in performance resulting from force majeure as defined by Article 1218 of the French Civil Code.
3.10 Mediation
After a prior written attempt to resolve the dispute with ROCKCROC, the consumer may refer the matter to:

Governing Law and Jurisdiction
These Terms and Conditions are governed by French law.
In the event of a dispute, and after an attempt at amicable resolution, jurisdiction shall be determined in accordance with applicable European consumer protection regulations.
Nothing in these Terms and Conditions shall deprive the consumer of mandatory rights granted under applicable consumer protection laws in their country of residence within the European Union.
